What is the process for applying for a spousal visa?
In the state of Washington, the process for applying for a spousal visa is outlined by the U.S. Citizenship and Immigration Services (USCIS). First, the petitioner (the spouse seeking the visa) must complete the Form I-130 “Petition for Alien Relative” and submit it to the USCIS. Along with this form, the petitioner must provide proof of their legal status in the U.S., a copy of their marriage certificate, and evidence of their financial ability to support the spouse. Next, the petitioner must submit Form I-129F “Petition for Alien Fiancé(e)” to the USCIS along with copies of documents verifying the validity of the marriage. Once the petition is approved, the foreign spouse must apply for an immigrant visa at their local U.S. Embassy or Consulate. The foreign spouse must fill out the non-immigrant visa application and submit it along with the original copy of the approved Form I-129F, marriage certificate, and any other required documents. After the application is reviewed, the foreign spouse will be called for an interview at the embassy. At the interview, the foreign spouse will be asked questions about their relationship with the petitioner and the validity of their marriage. Upon successful completion of the application and interview, the foreign spouse will be given a spousal visa. After arriving in the U.S., the foreign spouse must apply for a green card. Once the green card is obtained, the foreign spouse will be entitled to all the rights and privileges of a lawful permanent resident.
