How do I obtain a labor certification?

Labor certification is a necessary step for employers to hire foreign workers in the United States. In the state of Michigan, the Department of Labor & Economic Opportunity oversees the labor certification process. To obtain a labor certification, the employer must file an Application for Permanent Employment Certification (ETA Form 9089) with the U.S. Department of Labor. The employer must submit evidence that there is no available U.S. worker to fill the position, and that the hiring of the foreign worker will not adversely affect the wages and working conditions of U.S. workers. To meet this requirement, the employer must advertise the job for at least 30 days and conduct two recruitment steps. The employer must also submit a wage offer that meets the prevailing wage rate for the job in the geographic area where the employer is located. The U.S. Department of Labor will review the application and make a determination as to whether the employer has established that there are no qualified U.S. workers and that the hiring of the foreign worker will not adversely affect the wages and working conditions of U.S. workers. If the department approves the application, the labor certification will be valid for 180 days. Once the labor certification is approved, the foreign worker will be able to apply for permanent resident status with the U.S. Citizenship and Immigration Services. The foreign worker may be required to submit additional documents and pass a medical examination. Once all the requirements are met, the foreign worker may qualify to receive a Green Card and become a permanent resident in the United States.
