Labor certification is a necessary step for employers to hire foreign workers in the United States. In the state of Michigan, the Department of Labor & Economic Opportunity oversees the labor certification process. To obtain a labor certification, the employer must file an Application for Permanent Employment Certification (ETA Form 9089) with the U.S. Department of Labor. The employer must submit evidence that there is no available U.S. worker to fill the position, and that the hiring of the foreign worker will not adversely affect the wages and working conditions of U.S. workers. To meet this requirement, the employer must advertise the job for at least 30 days and conduct two recruitment steps. The employer must also submit a wage offer that meets the prevailing wage rate for the job in the geographic area where the employer is located.
