What are the requirements for employment-based visas?

In California, employment-based visas are available to certain foreign nationals who wish to work in the United States. These visas are divided into five categories, known as the Employment-Based Preference Categories. The first preference visa is an immigrant visa for individuals with extraordinary abilities in the sciences, arts, education, business, or athletics, as well as outstanding professors and researchers. The second preference visa is for individuals with extraordinary ability in the sciences, arts, or business, as well as advanced degrees or the equivalent combination of education and experience. The third preference visa is for skilled workers and professionals with a bachelor’s degree, or those with two or more years of experience in the field they wish to work in. The fourth preference visa is for certain special immigrants, such as certain ministers, religious workers, and employees of U.S. foreign media. The fifth preference visa is for immigrant investors who invest a minimum of $1 million into a commercial enterprise in the U.S. In addition to these categories, other visas may be available for individuals with special qualifications, such as artists and entertainers, agricultural workers, and seasonal workers. To be eligible for the employment-based visa, individuals must demonstrate that they are qualified for the position for which they are applying. To apply for an employment-based visa, individuals must submit a completed application with supporting documents to the U.S. Citizenship and Immigration Services (USCIS). USCIS will review the application and make a determination on the eligibility of the applicant. If approved, applicants will be issued a work visa that allows them to work in the United States.
