What are the requirements for employment-based visas?

In Texas, employment-based visas are reserved for foreign nationals who are seeking to enter and work in the United States. Generally speaking, employers must sponsor the visa applicant and demonstrate that there is a need for the foreign worker. To obtain an employment-based visa, foreign nationals must generally meet the requirements of one of five categories established by the United States Citizenship and Immigration Services. For category EB-1 visas, the applicant must be a person with extraordinary ability, an outstanding professor or researcher, or a multinational executive or manager. For EB-2 visas, the applicant must be a person who holds an advanced degree or has exceptional ability. The EB-3 visa requires that the applicant be a skilled worker, a professional, or an unskilled worker. Additionally, holders of EB-3 visas can also include certain religious workers. EB-4 visas are reserved for special immigrants, such as religious workers, skilled and unskilled workers, and foreign medical students. An EB-5 visa requires that the applicant invest in a business in the United States, create jobs, and integrate into the U.S. economy. In addition to these requirements, an applicant for an employment-based visa must demonstrate that they will not displace American workers, they have the necessary qualifications for the position, and they have the ability to support themselves financially while in the United States. Additionally, an applicant must pass a medical examination and background check. Finally, the applicant must demonstrate that the employer has the ability to pay the prevailing wage for the position.
