What are the requirements for employment-based visas?
In Kansas, employment-based visas are granted to foreign nationals who have been sponsored by an employer for a job in the United States. There are several different types of employment-based visas, but all require the employer to prove that there is a need for the foreign national to fill the position and that no qualified U.S. citizens or legal permanent residents are available to fill the position. The employer must first file an application with the Department of Labor certifying that the foreign national will fill a position that is a necessary part of the business. Then, the employer must file an immigrant petition with the U.S. Citizenship and Immigration Services (USCIS), which must be approved before the foreign national can apply for a visa. The foreign national must then apply for the visa by submitting several documents, including a passport, application form, a medical examination, and evidence of financial support. If the visa application is approved, the foreign national can enter the U.S. and begin working. In addition, certain foreign nationals may be eligible to receive permanent residence through an employment-based visa. This requires an employer to sponsor the foreign national and prove that the proposed job is a permanent one. The foreign national must also submit a permanent residence application and meet all other requirements for permanent residence. In order to obtain an employment-based visa, employers and foreign nationals must meet all the requirements outlined by the government. It is important to carefully review all documents and instructions before applying for an employment-based visa.
