What is the process for obtaining a provisional waiver?

The process for obtaining a provisional waiver in California is a complex one. For an individual to be eligible for a provisional waiver, they must be an immediate relative of a United States citizen and be in the process of obtaining an immigrant visa. Additionally, they must demonstrate that the refusal of their admission to the United States would cause “extreme hardship” to their U.S. citizen family members. Once they have demonstrated their eligibility, they may apply to the United States Citizenship and Immigration Services (USCIS) in California for a provisional waiver.
