What is the process for filing an application for a K visa?

In Indiana, filing an application for a K visa is a multi-step process that can take anywhere from several weeks to several months to complete. The first step is to fill out and submit Form I-129F, Petition for Alien Fiancé(e), to U.S. Citizenship and Immigration Services (USCIS). This form must be accompanied by the Petitioner’s original, signed Form I-134, Affidavit of Support, and other required documents. Once the USCIS accepts the petition, it is forwarded to the National Visa Center (NVC) for processing. The NVC will contact the petitioner or their attorney to advise of any additional documents needed to complete the petition. Once all documents are received, the NVC will contact the petitioner again to schedule an interview at the U.S. Embassy located in the country where the alien fiancé(e) resides. At the interview, the alien fiancé(e) must prove that the marriage is genuine, legal under the laws of the country where the marriage took place, and that the couple has an ongoing relationship. The visa will be granted if the officer is satisfied with the answers and documents provided. Once the visa is approved, the alien fiancé(e) must enter the U.S. within the validity period of the visa, which is six months. Upon arrival, the alien fiancé(e) must apply to adjust status for lawful permanent resident status, and submit documents to the USCIS along with a filing fee.
