What is the purpose of the Labor-Management Relations Act?
The main purpose of the Labor-Management Relations Act (LMRA) in North Carolina is to promote and encourage collective bargaining between labor unions and employers. The LMRA sets out how collective bargaining should be conducted, defines the practices and procedures of collective bargaining, and provides safeguards and protections for both labor and management. The LMRA also establishes the right of employees to form and join labor unions without interference from their employers. It also requires employers to engage in collective bargaining with specified labor unions and prohibits employers from discriminating against employees for belonging to a labor union or for engaging in union activities. Moreover, the LMRA requires employers to bargain in good faith and prohibits them from making certain unfair labor practices such as refusing to bargain, unjustly discharging an employee, or discriminating against an employee for certain union activities. The purpose of this is to protect the rights of labor in the workplace and to create a fair and functioning collective bargaining system in North Carolina. The LMRA also establishes the North Carolina State Employment Relations Board to enforce the provisions of the Act. The Board hears employee and employer complaints regarding violations of the Act and also enforce the remedies created by the Act. Overall, the purpose of the Labor-Management Relations Act is to ensure that labor and management in North Carolina have access to a fair, equitable, and effective collective bargaining system to protect the rights of both labor and management.
