How does information technology law intersect with labor law?
Information technology law (also referred to as IT law) intersects with labor law in a number of ways. In Washington, labor is governed by the Washington Industrial Safety and Health Act (WISHA). This law sets guidelines and standards for employers in regards to providing safe and secure working environments. Employers are expected to provide information technology law and security measures to protect their employees’ personal information and the information of customers and clients. Depending on the organization, this might include implementing measures such as password protecting sensitive data, regular security updates, or encryption of all sensitive data. In addition to security measures, certain labor laws have applications in information technology law. For example, the Fair Labor Standards Act (FLSA) dictates that employers in Washington must pay their employees a minimum wage and overtime for hours worked over 40 in a week. This law applies to IT professionals and tech support employees. Furthermore, IT law intersects with labor law when it comes to employee rights with regards to accessing certain data and information from the organization. For instance, unions have the right under labor law to see certain financial records in order to negotiate collective bargaining agreements. In this case, information technology law must be implemented to ensure that the information being accessed is done so in a secure and compliant manner. Overall, labor law in Washington interacts with information technology law in many ways. Understanding the regulations and laws related to both areas is important to ensure that employers in the state are compliant and that employees’ data and information is secure.
