How does information technology law intersect with patent law?

Information Technology (IT) Law intersects with patent law in two primary ways. First, patent law provides protection to inventors who have created and/or developed a new invention with a specific use. In order for the invention to be patentable, it must be novel, non-obvious, and new to the world. This means that inventions related to the IT field could potentially be patentable, and thus require protection from the law. Second, the technology itself may be protected by patent law. Often times software or hardware that are created through IT can be protected by a patent. This means that while others may not be able to replicate the invention, they still have the right to use it or create something similar to it. In other words, a patent protects the innovators’ ability to reap the rewards of their invention by limiting the competition who would otherwise be able to replicate their invention. Overall, IT law and patent law have a close connection with each other because patent law is designed to protect inventions from being copied without permission and/or compensation. IT technology can be patented and should be protected from being replicated without permission and/or compensation, so patent law helps to grant inventors the protection and recognition they deserve.
