What types of property are typically subject to inheritance law?
In inheritance law, property that passes from one person to another upon death is typically subject to inheritance law. In Florida, this generally includes real estate (houses, land, etc.), tangible personal property (vehicles, jewelry, etc.), intangible personal property (stocks, bonds, bank accounts, etc.), life insurance benefits, and other assets owned by the deceased person. Any specific bequest to a particular person in the deceased person’s last will and testament is also subject to inheritance law in Florida. In addition to the aforementioned items, the Florida Probate Code and other applicable state laws also allow for certain assets to be held in trust for the benefit of heirs, which are then subject to inheritance law as well. Finally, there are certain situations in which family members can receive assets from the deceased person even if there is no last will and testament in place. These situations are known as intestate succession, and assets that pass in this way are also subject to inheritance law.
