What are the requirements for a valid will?

In West Virginia, a valid will is one that is written and signed by an individual who is 18 or older, of sound mind, and not under duress or undue influence. The will must also be witnessed by two witnesses who are also not related to the person signing the will. Witnesses must be at least 18 years old and of sound mind and must sign the will in the presence of the testator (signer) and each other. Additionally, the will must clearly indicate the individual’s intention to create a legal document and must also clearly state the desires and wishes of the individual regarding how they want their assets and property distributed after death. Lastly, the will must also be properly notarized. In West Virginia, there are specific laws requiring a notary public or other authorized official to be present when the will is executed. The notary should ensure that all the requirements for a valid will have been met and should also sign and date the will. Following these steps and requirements will ensure that the will created in West Virginia is recognized and valid as per the state’s inheritance law.
