What happens if someone dies without a will?
If someone dies without a will in Pennsylvania, it is considered they have died "intestate." This means that the estate is divided according to the state’s Intestate Succession laws. In Pennsylvania, the estate will be divided among the surviving spouse and any children of the deceased. When it comes to inheritance, the surviving spouse will receive the entire estate if there are no surviving children or other lineal descendants of the deceased. However, if there are other lineal descendants, the surviving spouse will receive half of the estate and the other half will be divided amongst the lineal descendants.
