How is a will interpreted after someone dies?

A will is a legal document that a person creates to outline their wishes regarding the distribution of their estate after they have passed away. In Alaska, the interpretation of a will is handled by the state court system. When someone passes away, the first step in the process is for the executor of the estate to file the will with the court. The court system then begins a process known as probate, which is the legal process of executing a will’s instructions. During this process, the court will review the will and decide how to interpret and apply the instructions. The court will consider the language used in the will and if there is any ambiguity in the language, the court will use its own discretion to resolve the matter. The court will also consider the laws of inheritance in Alaska in order to ensure the will is applied correctly. For example, Alaska law stipulates that married couples must share their estate if one person passes away. Therefore, if the will does not make any provisions to the contrary, the court will follow the laws of inheritance. After the court has determined how the will should be interpreted, the executor must start the process of distributing the assets of the estate according to the wishes of the deceased. The court will monitor the process to ensure the will is being properly followed. Once all assets have been distributed, and all debts and taxes have been paid, the court will close the probate process. This allows the executor to finalize the estate and close the will.
