What is the difference between a testator and a beneficiary?
A testator is a person who has created a will to determine how their property and assets should be distributed upon their death. In Florida, a testator must be at least 18 years old and of sound mind when creating the will in order for it to be valid. A beneficiary is a person or entity who is named in the will to receive assets from the testator upon their death. Beneficiaries can include family members, friends, charities, and organizations. It is the testator’s responsibility to inform their beneficiaries of the will and its contents. In Florida, the law requires that a will must be in writing and signed by the testator, as well as two witnesses. The will also must be notarized in order to be valid. Upon the death of the testator, the will must be taken to the clerk of court in the county in which the testator resided. The clerk will then appoint an administrator to oversee the distribution of the estate. The main difference between a testator and beneficiary is that the testator creates the will and dictates how the assets will be distributed upon death, while the beneficiary is the person or entity that actually receives the assets and benefits from the will.
