What is the meaning of an executor?

An executor is an individual appointed to carry out the instructions of a deceased person, as laid out in a will, or an individual appointed by a court to manage the affairs of someone who has died without leaving a will. In Hawaii, an executor is specifically charged with the responsibility of managing the estate of a deceased person and distributing it in accordance with the will, if there is one, or with the state’s intestate (without a will) laws if there is not. The executor is responsible for collecting and securing any assets the deceased had, paying any debts and taxes, and then distributing the remainder of the assets according to the terms of the will or intestate laws. The executor is also responsible for filing the deceased’s final tax return, attending any necessary hearings, and preparing and filing the estate’s final account with the court. Executors must carry out their duties honestly and responsibly. They may also be liable for any damages caused by negligence or misconduct in the performance of their duties. This means that it is important to choose someone you trust to serve as an executor as they have the legal authority to manage all aspects of the estate.
