What is an upgrade/downgrade provision?

An upgrade/downgrade provision is a clause in an inheritance law in Alaska that is designed to prevent a drastic shift in property ownership when an estate passes from an older generation to a younger one. This clause allows the younger generation to upgrade or downgrade the value of assets while maintaining the equal division of the estate. For example, if the younger generation wished to keep a family home but the estate could only provide them with cash, the upgrade/downgrade clause would allow the younger generation to take the cash and use it to purchase a home of equal or greater value. This provision allows for the younger generation to continue with life as close to normal as possible. Additionally, the upgrade/downgrade clause may be used to settle disputes between family members regarding the distribution of property. It allows each family member to take responsibility for their inheritance without having to worry about the value shifting too dramatically.
