What is anancillaryadministration?
An ancillary administration is a type of estate administration in Maryland Inheritance Law. This form of administration applies when the decedent, the person who has died, owned property in the state of Maryland but had their principal residence outside of the state. This type of administration is helpful when an out-of-state executor is appointed and needs assistance in the administration of the estate in Maryland. During an ancillary administration, a personal representative is appointed in the county in which the property is located in Maryland to ensure the estate is properly administered. The personal representative is responsible for collecting, recording and distributing the decedent’s assets located in Maryland in accordance with the decedent’s will. Furthermore, the personal representative is responsible for filing documents with the probate court, accounting for the distribution of assets and filing estate and income tax returns in Maryland. After all debts are paid and any remaining assets are distributed to beneficiaries, the personal representative will request approval from the court to close the estate.
