What is anancillaryadministration?

An ancillary administration is a type of probate process used when a person dies with property located in more than one state. This occurs when a person, known as a decedent, dies with property in multiple states. In New Hampshire, an ancillary administration must be opened in order to distribute property from one state to another. Ancillary administrations can also be used when a person dies with an estate worth more than $100,000 spread out over multiple states. This is a process set up to ensure that estate assets are distributed according to the laws of each state, and that taxes are paid on all assets. This type of administration must be opened in each state in which the decedent had property, and each ancillary administration is overseen by a court in that state. The ancillary administration process in New Hampshire includes filing a petition with the court in the applicable state. The petition must include information about the decedent, his or her estate and a list of all assets located in the state. It also includes a list of heirs and their addresses. The court will review the petition and decide whether or not to open an ancillary administration. If the court grants the petition, it will appoint a personal representative to oversee the administration and distribution of the estate.
