What is the Uniform Probate Code?

The Uniform Probate Code (UPC) is a set of laws that was created to regulate inheritance in Alabama and all other U.S. states. It is based on a model law that was written in 1969 in order to help simplify the estate law process across the nation. The UPC applies to all wills, estates, trusts, and guardianships. The UPC outlines how a property can be transferred after the death of an individual. It explains the process of creating a will, the methods for determining how an estate is divided, and how it is managed until it is transferred. In addition, the UPC includes the rules for how estate taxes are calculated and how disputes over inheritance can be resolved. The UPC also includes specific rules that govern inheritance for minors. It outlines the rights that minors have to property and the restrictions on guardianship of minors. The UPC is designed to provide consistency across state lines, making it easier for individuals to transfer their property after death. Every state has adopted some version of the UPC, and they are regularly updated to keep up with changing times.
