What is the Uniform Probate Code?
The Uniform Probate Code (UPC) is a set of laws that establishes how inheritance disputes should be handled in Hawaii. The UPC is often referred to as the “law of wills,” and it governs the distribution of assets when someone dies. It sets out the rules for determining who is entitled to what estate assets, including those that can be subject to inheritance disputes. The UPC is important in Hawaii because it helps ensure that families are not burdened with costly and time-consuming estate disputes. In Hawaii, the Uniform Probate Code is based on the Uniform Probate Code developed by the National Conference of Commissioners on Uniform State Laws. The UPC is reviewed and revised periodically to ensure it reflects changes in the law.
