What is the Uniform Probate Code?
The Uniform Probate Code (UPC) is a set of laws that was designed to provide uniformity in how states address inheritance laws. The UPC was created in 1969 by the National Conference of Commissioners on Uniform State Laws, and was enacted in Washington in 1974. The UPC is made up of numerous sections that cover different aspects of inheritance law, such as intestate succession, wills and living trusts, guardianships, and estates of persons who have died without a will. For example, one important part of the UPC is the Intestate Succession Act, which explains how a person’s property and possessions are distributed if they die without a will. In addition to addressing specific issues related to inheritance laws, the UPC also allows for some flexibility in how each state can address various inheritance laws. For instance, states can adopt a variety of “opt-out” provisions that allow them to exempt certain aspects of the law if it’s in their best interest. In Washington, the UPC applies to all individuals and estates, regardless of the size of the estate. The Uniform Probate Code is an important part of inheritance law because it provides a consistent set of laws across all 50 states, so that the rights of individuals and their families are protected after the death of a loved one.
