What is a non-judicial settlement agreement?
A non-judicial settlement agreement is a method of settling inheritance disputes in Alabama without involving the courts. This type of agreement is used when all parties involved agree to talk out their differences and come to an agreement on the division of inheritance assets without involving the court system. A non-judicial settlement agreement is made by all parties at the same time and they are generally not binding on any other party that was not part of the agreement. This type of agreement allows for individuals to come to a mutually beneficial agreement without needing the assistance of a lawyer or expensive court processes. All parties to the agreement must voluntarily agree to the terms of the settlement and sign the agreement in order for it to be valid. In addition, the settlement agreement typically has to include the full value of the assets being divided in order for it to be enforced in court. In order to make a non-judicial settlement agreement legal, all parties must agree to all terms of the agreement and it must be in writing and signed by all parties. It is important that all parties have the opportunity to fully understand the agreement before signing it and that each party is aware of the rights and responsibilities for the agreement.
