What is the difference between public and private international law?
Public and private international law are two distinct areas of international law that deal with very different matters. Public international law regulates the relations of states and other international entities, such as international organizations, and is based on the consent of states. Private international law, on the other hand, deals with the conflicts between private individuals of different states, and is based on individual rights operating across states. Public international law focuses on issues such as sovereignty, treaty and customary law, international trade, international human rights, international criminal law, and the law of the sea. Public international law also deals with diplomatic relations and with the implementation of international agreements. In contrast, private international law attempts to resolve conflicts between private individuals that arise from different national laws. Private international law covers topics such as citizenship, international family law, extraterritorial jurisdiction, and choice of law, among other topics. Private international law is also concerned with corporate activities and transactions which span different countries. Overall, the main difference between public and private international law is that public international law deals with the relations between states and organizations, while private international law deals with the conflicts between private individuals of different states.
