What is the International Court of Justice Advisory Opinion?
The International Court of Justice (ICJ) Advisory Opinion is a legal opinion issued by the ICJ in response to a request made by a nation or international body. Essentially, the Advisory Opinion is an authoritative legal decision, meaning that the consequences have legal weight and must be accepted by the nation or international body, unless the decision is later overturned by the ICJ. The Advisory Opinion can be issued on a wide range of topics, from the lawfulness of a certain action, to a dispute between two or more nations. The ICJ will also offer its opinion if a dispute arises between two or more nations concerning their respective rights and obligations under international law. The Advisory Opinion in Colorado is only advisory and not binding. Therefore, a state is not obligated to abide by it. However, if a state accepts the opinion, it can use it in domestic courts as a basis for making legal decisions. Furthermore, an international body or state that has accepted an Advisory Opinion has an obligation to give “due regard” to it as prescribed by the ICJ Statute. When the ICJ considers a request for an Advisory Opinion, it will look at both the legal circumstances surrounding the case, as well as the political implications of the case. Depending on the circumstances, the ICJ may decide to accept or reject the request. If accepted, the ICJ will then issue a detailed opinion on the matter.
