What is the International Convention on the Settlement of Investment Disputes (ICSID)?
The International Convention on the Settlement of Investment Disputes (ICSID) is an international legal agreement ratified by 143 countries, including the United States and the Commonwealth of Massachusetts, that seeks to protect and promote foreign investments. It is administered by the World Bank, an international body that promotes development and economic stability. The Convention requires that foreign investors be provided with secure protection and encourages the settlement of disputes between foreign investors and a country, its agencies, or an entity within the country. To that end, it establishes a number of "Conciliation and Arbitration Rules" that govern the resolution of disputes. These rules provide for the formation of a tribunal composed of three members who are experts in international law, and who can issue binding decisions. The ICSID also allows investors to file claims against a state or its agencies, if they believe that their investments have been treated unfairly. For example, if an investor believes that a state has taken a measure or enacted a policy that has caused the investor to suffer financial losses, the investor may be able to file a claim. In summary, the International Convention on the Settlement of Investment Disputes (ICSID) is an international agreement that is designed to protect and promote foreign investments. It establishes a dispute resolution system that allows foreign investors to seek redress for any losses caused by the actions of a state or its agencies. It is administrated by the World Bank and is ratified by 143 countries, including the United States and the Commonwealth of Massachusetts.
