What is the International Convention on the Rights of Persons with Disabilities (CRPD)?
The International Convention on the Rights of Persons with Disabilities (CRPD) is an international human rights treaty that was adopted by the United Nations General Assembly in 2006. It is a comprehensive set of standards that protects the rights of persons with disabilities around the world. The convention includes specific provisions regarding the right to life, health care, access to education, work, social security, participation in cultural life, and freedom from exploitation and abuse. The United States signed the CRPD in 2009, however, it has not yet been ratified. In North Dakota, the CRPD has not been ratified but state laws such as the Americans with Disabilities Act (ADA) and the Individuals with Disabilities Education Act (IDEA) help protect the rights of persons with disabilities. Other laws such as the Olmstead v. L.C. case, where the court ruled that unjustified institutionalization of individuals with disabilities is a form of discrimination, also help protect the rights of persons with disabilities in North Dakota. The CRPD represents an important step towards furthering the rights of persons with disabilities internationally and North Dakota should take steps to ratify the CRPD in order to ensure that all individuals in the state have access to the same rights and protections as individuals with disabilities in other countries.
