The International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families (CMW) is an international agreement that sets forth a number of rights for migrant workers and their families living in countries around the world. The Convention is intended to protect the rights of migrant workers and their families, such as the right to fair wages, freedom from discrimination, and humane working conditions. It also provides for the exercise of their rights to education and health care. The Convention was adopted by the United Nations General Assembly in 1990, and entered into force in July 2003. The United States has yet to ratify the Convention, meaning it does not form part of its domestic law. Nonetheless, North Dakota is obligated to uphold the principles of the Convention, given that all states have a duty to protect the human rights of migrants under customary international law. In essence, the Convention affirms the principles of fundamental human rights. It states that migrants shall be treated with respect and dignity, and should have access to work and all other related services on an equal basis with nationals of the countries in which they reside. It also covers the rights of migrants to reunite with their families, to participate in public life, and to access social services, among other rights.
