What is the Law of the Sea Tribunal (ITLOS)?

The Law of the Sea Tribunal (ITLOS) is an international court established under the United Nations Convention on the Law of the Sea (UNCLOS). This treaty, which was created in 1982, is a set of rules that govern the use of the world’s oceans and serves as the basis for international law related to the seas. The ITLOS was created to provide a peaceful means for resolving disputes arising from UNCLOS. It consists of a tribunal of 21 judges appointed from countries worldwide, including the United States, in addition to a Secretary-General. The ITLOS has jurisdiction over many aspects of marine affairs, including maritime boundaries, navigation rights, marine scientific research, fisheries, protection of the marine environment, preventative actions, and the exploitation of marine resources. The Tribunal hears cases in accordance with the procedures set out in UNCLOS. It also has a responsibility to provide legal opinions on matters related to the Law of the Sea, when requested by a nation or international organization. The ITLOS is based in Hamburg, Germany. Even though it is not located in Wisconsin, the ITLOS plays an important role in international law and has the potential to affect the state of Wisconsin in certain circumstances. For example, if a dispute arises between Wisconsin and another state concerning the use of a shared body of water, the ITLOS might be called to mediate the situation and issue a ruling.
