What is the International Convention for the Protection of All Persons from Enforced Disappearance (CPED)?

The International Convention for the Protection of All Persons from Enforced Disappearance (CPED) is a United Nations Human Rights treaty that was adopted by the UN General Assembly on 20 December 2006. This convention provides international legal protection for people who are subject to enforced disappearance --also known as kidnapping or secret detention by state and non-state actors -- and outlines procedures for investigating and prosecuting those responsible for such acts. The CPED contains a wide array of protections to aid in the prevention of enforced disappearances, as well as in the monitoring of those accused of committing such acts. For instance, the convention outlines measures such as increased government transparency and the monitoring of persons who are under suspicion of being involved in disappearances. Additionally, the CPED requires any person who is arrested or detained to be informed of their rights, and that they be allowed access to a lawyer and a family member. In Georgia, the CPED was signed in September 2017. The Georgian government has taken measures to ensure that the CPED is implemented in full, including the creation of an agency and an advisory council to monitor and investigate enforced disappearances. However, this has been met with some criticism as there is still much work to do in terms of enforcing the CPED and protecting people from enforced disappearances.
