What is insurance law?

Insurance law is the body of regulations and rules that govern the purchase, sale, and use of insurance policies. Insurance law can vary by state, and in South Carolina, the South Carolina Department of Insurance is the governmental agency that regulates and enforces insurance laws. Insurance law covers a wide range of topics, from the rights and duties of insurance companies and policyholders, to the regulation of policies, fees, and rate structures. It also covers legal requirements that must be met for a policy to be considered valid and enforceable, and the remedies and means for settling disputes between insurers and policyholders. Insurance law also covers consumer protection topics, such as the regulation of unfair and deceptive trade practices, anti-discrimination laws, and the protection of consumers from fraudulent and deceptive acts and practices. It also covers types of insurance that must be provided for certain circumstances, such as automobile insurance, workers’ compensation insurance, and disability insurance. Additionally, insurance law includes laws that require companies to provide certain coverage in certain circumstances, such as property insurance for rental properties, health insurance for employees, and life insurance for those in certain professions. The goal of these laws is to ensure that consumers have the necessary coverage and protection from unexpected losses.
