How do I challenge an insurance company’s decision?

The first step to challenging an insurance company’s decision is to read your policy in full. Make sure that you understand and agree to all of the terms and conditions of the policy. If you disagree with any part of the policy, then you may wish to contact your insurance provider directly to ask for more clarification. If you believe the insurance company’s decision to be unjust or incorrect, you have the right to appeal the decision. In South Dakota, you are allowed to submit a written appeal to the insurance company within 30 days of receiving the original decision. Your appeal should include the reason why you believe the decision is incorrect, any evidence that supports your position, and any additional information you’d like to provide. If you disagree with the decision after appealing it, you may wish to seek legal advice. If the dispute is not resolved, then you may need to take the insurance company to court. You will need to file a complaint with the Circuit Court in your county within three years of the original decision in order to dispute the decision in court. In this case, an insurance law attorney may be able to offer you advice and represent you during the case.
