Are there any laws related to online data mining?

In Hawaii, the Department of Commerce and Consumer Affairs (DCCA) is responsible for online data mining regulations. The agency specifically regulates online data mining practices through the Unfair and Deceptive Practices Act. This act prohibits companies from using online data mining to exploit customers or gain information without their knowledge or consent. For example, it is illegal for companies to mine online data by using deceptive tactics such as creating fake accounts in order to gather user information. Companies must also provide customers with a full disclosure of how their data will be used, as well as allowing customers the ability to opt out of having their data collected. The DCCA also requires companies to establish privacy policies that must be kept up to date and given to customers upon request. These policies must outline the company’s data collection and use practices. The DCCA enforces these regulations through their Division of Consumer Advocacy. They can levy fines and issue corrective orders to companies that fail to comply with the act. In addition to the regulations set forth by the DCCA, the state of Hawaii has enacted the Hawaii Consumer Protection Act which prohibits companies from using unfair or deceptive advertising practices. This includes data mining. Therefore, companies must be transparent with their data collection practices and provide customers with the ability to opt-out of data collection. Finally, the Hawaiian Constitution also protects the right to privacy, including the right to keep personal data safe from unauthorized access. Companies that violate the right to privacy can be subject to civil lawsuits.
