How is an investment law enforced?
In Washington, investment law is enforced by the Washington State Department of Financial Institutions (DFI). The DFI is responsible for monitoring and enforcing consumer protection laws, as well as regulating the activities of investment advisors, companies, and securities brokers. The DFI, through its Division of Securities, works to ensure investors are not taken advantage of in financial transactions. They provide information to investors about the risks of investing in securities, and investigate possible fraud or manipulation of the securities market. The DFI also has the ability to issue disciplinary orders, including monetary penalties, cease and desist orders, and suspensions or revocations of licenses, to companies and individuals who fail to comply with investment law. They may also refer cases to the Attorney General or to local district or county attorneys for criminal prosecution. Because the enforcement of investment law is so important, the DFI conducts regular examinations of firms and investigates consumer complaints. They also review materials such as registration forms, prospectuses, and other financial documents. It is important for investors to be familiar with the laws and regulations regarding investments, and to report any violations to the DFI. By taking these steps, investors and the DFI can help protect Washington investors from fraud and financial loss.
