How is an investment law amended?
An investment law in Florida can be amended in one of two ways: by the Legislature or the Commission. The Legislature, being the highest power in Florida, has the ability to pass new and amend existing laws. This includes amending investment laws, such as laws governing the sale of securities or financial advice for investors. The Commission, a group appointed by the Governor, also has the power to amend investment laws. This is done through public hearings in which the Commission reviews and consider public comment. After such review, the Commission has the authority to modify investment laws based on the input they receive. In either case, the process of amending an investment law starts with the drafting of a proposed amendment, which outlines the changes being sought. The proposed amendment then goes through the legislative or commission review process, depending on the type of amendment sought. Once the amendment has been reviewed and approved, it is then sent to the Governor for vote and final approval. Once approved, it will become the official law in Florida.
