What is International Intellectual Property Law?
International Intellectual Property Law is a branch of law that governs how intellectual property (IP) is used and protected in multiple countries around the world. This type of law is necessary because it helps to ensure the creators of original works of art, literature, and inventions are properly credited and compensated for their work and inventions. In California, international intellectual property law is based largely on the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). This agreement binds all members of the World Trade Organization (WTO) to enforce certain intellectual property rights, such as copyrights, patents, and trademarks. International Intellectual Property Law also includes treaties between countries, such as the Berne Convention. This treaty grants authors of certain kinds of works, such as music, literature, and art, protection from unauthorized use of their work. It also sets up rules for determining who are the original authors of works, and who owns a copyright. By enforcing International Intellectual Property Law, member countries of the WTO and other treaty organizations are able to ensure that the creators of unique works are rewarded for their creativity, and that consumers are able to purchase original works. This encourages innovation and creativity, and ensures that authors and inventors receive just compensation for their unique creations.
