What is the difference between an invention and an idea?
An invention is a result of creative work that produces a tangible product or provided a service, while an idea is simply a concept that has yet to be turned into an invention. In Louisiana, Intellectual Property Law provides protection for inventions, but not ideas. An invention is subject to patent or copyright protection, depending on the type of invention. An idea cannot be patented or copyrighted, though it may still be protected as a trade secret. Inventions must be something new, useful, and non-obvious. This means that the invention must be an improvement over existing products or services. An idea, on the other hand, does not need to meet any of these criteria. An invention must be concrete, while an idea may be just an abstract concept. For an invention to be patented, it must also meet certain standards set forth by the U.S. Patent and Trademark Office. These standards may be different for different types of inventions. The protection provided by Intellectual Property Law is an important way to ensure that inventors have the exclusive rights to the products or services of their invention. A patent grants the inventor the exclusive right to make, use, and sell the invention, while a copyright provides the inventor exclusive rights to the artistic or literary content of their invention. Though an idea is not protected by intellectual property law, it is the concept that forms the basis of an invention. Without ideas, inventions would never be created.
