What is an unfair competition case?

An unfair competition case is a legal claim that one business has been harmed by the wrongful actions of another business. In Utah, an unfair competition claim can be brought under certain state and federal consumer protection laws. Generally, an unfair competition case alleges that another company has unfairly or unlawfully gained an advantage by damaging a business’s reputation or competing with the business’s products or services. Unfair competition can occur when a competitor uses deceptive tactics to lure customers away, makes false claims about its own products, or interferes with a business’s contractual or business relationships. In addition to these situations of unlawful competition, unfair competition law also prohibits businesses from engaging in activities that are contrary to public policy. For example, this type of law could prevent a company from taking out false advertising in order to harm a competitor or from copying a competitor’s products or services in order to gain an unfair advantage. In Utah, unfair competition claims may be brought in state court or in federal court. When an action is brought in state court, the law of the state of Utah applies, and the plaintiff must prove that a wrongful act was committed and that they incurred damages as a result of the act. When an action is brought in federal court, the plaintiff must prove that the defendant’s actions were in violation of the federal unfair competition law.
