What is an unfair competition case?

An unfair competition case is a legal claim that one business has been harmed by the wrongful actions of another business. In Utah, an unfair competition claim can be brought under certain state and federal consumer protection laws. Generally, an unfair competition case alleges that another company has unfairly or unlawfully gained an advantage by damaging a business’s reputation or competing with the business’s products or services. When an action is brought in federal court, the plaintiff must prove that the defendant’s actions were in violation of the federal unfair competition law.
