What is copyright infringement?

Copyright infringement is when someone uses a copyrighted work without permission. Copyrights are exclusive rights given to the creator of an original work, such as a literary or musical piece, to reproduce or distribute the work. In New Mexico, copyright infringement is a violation of the federal Copyright Act. A copyright owner has the right to prevent others from reproducing, distributing, performing, or displaying their original work in any way without permission. Even if someone makes slight changes to the copyrighted work, this is still considered copyright infringement. For example, if you produce a movie and someone else takes that movie and makes a sequel or remake without your permission, that would be copyright infringement. Additionally, if you make a drawing or music composition and someone else uses it to make a t-shirt design without your permission, that is also copyright infringement. In New Mexico, copyright infringement is punishable with civil and criminal penalties. The Copyright Act allows for an award of damages, and in some cases, the copyright owner may be entitled to recover profits that the infringer earned. In addition, a person can be sentenced to jail time or face other criminal penalties for repeated or intentional copyright infringement.
