What is a trade dress infringement?

A trade dress infringement is a violation of intellectual property law in Tennessee. It occurs when an individual or group attempts to copy the visual appearance of another company’s product or packaging. The concept of trade dress is not exclusive to Tennessee, but is a federal law that applies in all fifty states. Trade dress infringement occurs when a company uses the same visual characteristics of another company’s product or packaging without that company’s permission. This can include the shape, size, color, texture, or overall appearance of a product or its packaging. For example, if Company A has a particular design of sneakers that makes them recognizable, and Company B starts making a very similar shoe, Company A could have a trade dress infringement claim. In Tennessee, individuals or companies that want to protect their trade dress can register their design with the U.S. Patent and Trademark Office. This allows them to obtain legal protection against trade dress infringement. It’s important for companies to understand that they can’t simply copy another company’s design or idea in order to compete. Doing so could result in legal proceedings. It is important for companies to understand and follow the law regarding trade dress infringement in order to avoid costly legal battles.
