What is a trade dress infringement?

A trade dress infringement is a violation of intellectual property law in Texas. It is when someone uses the look and feel of a brand, product, or service that is protected by copyright law. For example, if a company creates a unique logo, color scheme, packaging, or design for its products and another company copies or imitates those features, it is considered a trade dress infringement. In other words, when someone illegally uses another company’s “trade dress” or branding elements, they are violating intellectual property law in Texas. When a trade dress infringement has occurred, a company can file a lawsuit against the infringer for damages or to stop them from using the trade dress. When sued, the infringer may be ordered to pay the plaintiff damages for any profits made using the trade dress. They may also be ordered to stop using the trade dress and modify or destroy any products using the intellectual property. In addition to filing a lawsuit, a company can protect itself from trade dress infringement by registering their logo with the United States Patent and Trademark Office. This will give the company exclusive rights to the logo, making it easier to prove trademark infringement in court if someone else copies the logo. By following these steps, companies can protect their intellectual property and avoid being accused of trade dress infringement in Texas.
