What is the process of registering a trademark?
In New Mexico, the process of registering a trademark is governed by the United States Patent and Trademark Office (USPTO). The steps to registering a trademark involve first doing a trademark search. This search is done to check if the trademark already exists as a federally registered trademark or as a pending trademark application. Once the trademark search is complete, the next step is to file the trademark application with the USPTO. This application must include the name of the applicant, the goods or services for which the trademark is being registered and the specific description of the trademark. After the application has been filed, the USPTO will review it and check to make sure it meets all the requirements for a valid trademark. If the USPTO approves the application, it will be published in the Official Gazette and an official Certificate of Registration will be issued. The registration will remain active for 10 years, in which time the trademark holder must actively engage in normal business activities that involve the use of the trademark. Once the trademark is successfully registered, the trademark holder will be granted exclusive rights to use the mark for their goods and services, and the mark will also be protected against infringement by other businesses. In addition, the trademark registration will give the owner the ability to gain recognition for their brand and will help to ensure that competitors can’t use a similar trademark for their own products or services.
