What is the Berne Convention?
The Berne Convention is an international agreement that sets standards for copyright protection around the world. The Convention was created in 1886 at a meeting of the Berne Union and adopted by many countries, including the United States in 1989. The purpose of the Convention is to grant authors the same basic copyright protection in all countries signatory to the agreement, regardless of where their works are created or published. Under the Berne Convention, the copyright holder is granted certain exclusive rights. These include the right to reproduce the work, to display it, to create derivative works, and to distribute it. The copyright holder also has the exclusive right to authorize or prevent the use of their works in any form. The Berne Convention also sets forth the term of the copyright protection for different works. For most works created after the Convention was first adopted in 1886, the term of protection is the life of the author plus fifty more years. Other works, such as anonymous works, works of joint authorship, or works of corporate authorship may have different terms of protection. The Berne Convention is important because it offers authors and creators around the world the same basic copyright protections, no matter where their works are created or published. It is also important because it provides legal protection for these works in the United States and in many other countries.
