What is the notice of infringement under the DMCA?
The Digital Millennium Copyright Act (DMCA) is a federal law designed to protect copyrighted works from infringement on the internet. Under this act, a website owner must provide a notice of infringement if they find that someone has posted their copyrighted material without their permission. This notice of infringement must include a description of the copyrighted work that was infringed upon, the online location of the infringing material, contact information for the copyright owner, and a statement that the owner believes in good faith that the use of the material is not authorized by the copyright owner. It must also state that the information in the notice is accurate, and that the owner is either the copyright owner or their authorized agent. Once the website owner has sent the notice of infringement, the website must remove or disable access to the infringing material. This is to prevent the unauthorized use of the material. In Michigan, the Department of Justice handles all complaints and requests for takedown notices. The copyright owner must provide proof of ownership and contact information before they can file a complaint. The process may take up to 60 days before the infringing material is taken down.
