What is the difference between copyright and design protection?

Copyright and design protection are two distinct legal concepts within intellectual property law. Copyright law seeks to protect the original expression of ideas in the form of art, writing, music, and other works. Design protection, on the other hand, seeks to protect the appearance, shape, or configuration of physical products or objects. In New Mexico, copyright usually applies to literary, artistic, or musical works, or computer programs. It grants the original creator exclusive rights to the work. Copyright protection does not cover physical objects and cannot protect against the unauthorized production of a product that is identical or substantially similar to the original. Design protection, also known as industrial design protection or trade dress protection, is different from copyright in that it protects the look and feel of products. This includes the design, aesthetic considerations, the visual features of objects, as well as the arrangement or composition of the elements that make up the product. In New Mexico, an industrial design registration is required for a product to be effectively protected. It ensures that other parties cannot unfairly benefit from the ideas of the original inventor. In summary, copyright protection protects the expression of ideas, while design protection protects the appearance and arrangement of physical products. In New Mexico, copyright requires registration whereas design protection requires industrial design registration.
