How long does it take to obtain a patent?

In Florida, it typically takes around two to three years to obtain a patent. This depends on the complexity of the invention and the amount of paperwork involved in the process. The first stage is filing a patent application with the United States Patent and Trademark Office (USPTO). It usually takes a few months for the USPTO to process the application. This is followed by a series of reviews and revisions before the application is approved. After the application is approved, the invention is published in the USPTO’s Official Gazette and notice is sent to the inventor to allow anyone to challenge the patent. If no challenges are made, then the patent is issued after eight to twelve months. In the case of a fast-track application, the process may be shortened to about 12 months. This may be applied when the invention is of a special public interest. This is usually the case with medical inventions, where the inventor may have access to quicker and more supportive review and approval processes. In Florida, once the patent is approved, the inventor is given an exclusive right to use, produce, and market the invention. This right lasts for twenty years. After this, the patent is retired and other inventors may apply for a patent on the same invention.
