What is the protection afforded by a trademark?

A trademark is a form of intellectual property protection that legal rights are granted to a name, phrase, logo, or design that is used to distinguish a business’s products or services from other competitors in the marketplace. In South Carolina, trademarks are protected under what is called the Lanham Act, which provides the owner with an exclusive right to use the trademark as well as the ability to prevent others from infringing on those rights. Trademark protection is important because it helps to prevent confusion in the marketplace by preserving the distinctive nature of the trademark and preventing others from using confusingly similar marks. A trademark also helps to create a brand identity for a business, which can help to attract customers and build loyalty. Additionally, trademark protection helps to protect the goodwill of a business by preventing competitors from unfairly capitalizing on the business’s brand. A trademark owner can take legal action against someone who attempts to use the trademark without permission or who uses a confusingly similar mark. This legal action can include an injunction, which would require the infringing party to cease use of the trademark, as well as the potential for damages that may be awarded if the trademark was willfully infringed upon. By protecting a business’s trademark, the Lanham Act ensures that the business’s brand and goodwill are protected, which in turn helps the business remain competitive in the marketplace.
