What is the scope of copyright protection?

Copyright law protects original works of authorship, including literary, dramatic, musical, and artistic works. This protection applies from the moment of creation, and extends for the life of the author plus 70 years. Copyright laws are designed to protect an author’s financial investment in a work and to incentivize authors to create new works. In New York, copyright law grants the author exclusive rights to reproduce, distribute, display, and perform their work publicly, as well as create derivative works. It also grants the author the right to transfer these exclusive rights to another person or entity. Copyright law also includes the right to control the use of copies of the work, including making or authorizing the making of copies, or creating compilations from the work. Copyright protection does not, however, protect an idea, concept or facts, but only the expression of it. The scope of copyright protection is limited by this distinction. Certain uses of the work may also be allowed under exceptions provided for by law, such as fair use. In New York, these exceptions may permit the use of copyrighted works for research, educational, and journalism purposes. In addition to copyright protection, New York also recognizes other forms of intellectual property law, such as patent and trademark protection. Patent law protects inventions, while trademark law protects specific words, symbols, and/or designs that distinguish goods and services. In sum, the scope of copyright protection in New York provides authors with the exclusive right to control the use of their works. This right is limited by certain exceptions, such as fair use, and does not extend to protect ideas, concepts, or facts.
