What is trademark dilution?
Trademark dilution is a form of intellectual property law that occurs in Texas and other states. It happens when someone else uses a trademark that is owned by someone else in a manner that is detrimental to the owner of the trademark. This could be done in a number of ways, such as using the trademark in a way that is likely to cause consumer confusion, using the trademark in a way that makes the trademark less distinctive, or using the trademark to imply an endorsement or association with the trademark holder. Trademark dilution can have serious financial consequences for the trademark holder. In Texas, the trademark holder may be able to pursue civil damages or even seek a court order for an injunction to stop the infringer from using the mark. The trademark holder may also be able to obtain an order requiring the infringer to destroy any counterfeit products or advertising materials that have been produced using the trademark without permission. Trademark dilution can also have a serious impact on the reputation of the trademark holder and can tarnish the goodwill associated with the trademark. This can lead to a loss of business and customers for the trademark holder. By protecting the owner’s trademark, intellectual property law helps protect the value of their brand and the investments they have made in it.
