What are moral rights in intellectual property?

Moral rights in intellectual property are legal rights that protect the creators of certain types of works. In Mississippi, these rights are established by the Mississippi Visual Arts Protection Act. Under the Act, a creator has the exclusive right to claim authorship of their work and to protect against any intentional distortion, mutation, or other modification of their work. Moral rights in intellectual property protect the honour and reputation of the creator. As such, a creator can decide how their work is used and what it is called, and requires that they be credited when their work is exhibited, broadcasted, or otherwise used. Any copying or other use of a work without the consent of the creator would be infringing on the creator’s moral rights. Enforcement of moral rights is essential for creators to protect the integrity of their work. In Mississippi, creators can file a lawsuit if their moral rights are infringed upon. If the court finds that the defendant did in fact infringe on the creator’s rights, then the copyright holder may be awarded damages, attorney’s fees, and other costs. Moral rights provide a sense of security and value to creators, allowing them to protect their work from unauthorised use and to maintain the reputation of their work. Although these rights are limited in Mississippi, the state does recognise and protect the creators of certain works.
